A structured settlement is a negotiated financial arrangement in which a claimant agrees to resolve a personal injury, workers' compensation, or wrongful death claim by receiving periodic payments over time rather than a single lump sum. Payments are funded through an annuity purchased by the defendant or their insurer.
The tax treatment of structured settlement payments depends on the type of damages being settled. Payments for qualifying personal physical injury or physical sickness claims are received income tax-free under IRC §104(a)(2), including the growth. Wrongful conviction settlements may qualify under IRC §139F. By contrast, structured attorney fees, employment settlements, and other taxable damages are treated differently — typically as tax-deferred income rather than tax-free.
